1. Introduction and Acceptance

Welcome to GESTA Tours & Travel Ltd. These Terms and Conditions govern your use of our services and website. By booking any travel service with GESTA Tours & Travel Ltd., you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.


2. Company Information

GESTA Tours & Travel Ltd. is a registered travel agency operating in Kenya, with our headquarters located at Vision Plaza, Mombasa Road, 4th Floor, Suite 9B, Nairobi. We specialize in domestic and international travel services including air ticketing, hotel reservations, holiday packages, corporate travel, and group tours.


3. Booking and Reservations

3.1 Booking Process

All bookings must be made through our authorized channels including our office, phone, email, or website. A booking is confirmed only when we issue a written confirmation via email or physical document.

3.2 Payment Terms

  • A deposit is required at the time of booking. The deposit amount varies depending on the service and will be communicated during booking.
  • Full payment must be received at least 14 days before the travel date unless otherwise agreed in writing.
  • Payments can be made via bank transfer, mobile money (M-Pesa), or cash at our office.
  • All prices are quoted in Kenya Shillings (KES) or US Dollars (USD) and are subject to change until full payment is received.

3.3 Pricing

  • All prices quoted are per person unless otherwise stated.
  • Prices include services specifically mentioned in your itinerary or booking confirmation.
  • Prices are subject to change due to currency fluctuations, fuel surcharges, government taxes, or increases by service providers until full payment is received.
  • We reserve the right to pass on any increases in costs to clients, even after booking confirmation.

4. Cancellations and Refunds

4.1 Cancellation by Client

Cancellations must be made in writing via email to reservations@gestatours.com. Cancellation charges apply as follows:

  • More than 30 days before travel: 25% of total booking cost
  • 15-30 days before travel: 50% of total booking cost
  • 7-14 days before travel: 75% of total booking cost
  • Less than 7 days before travel: 100% of total booking cost (no refund)

4.2 Cancellation by GESTA Tours & Travel

We reserve the right to cancel any booking due to insufficient numbers, force majeure, or circumstances beyond our control. In such cases, we will offer an alternative travel date or full refund of amounts paid.

4.3 Refund Processing

Approved refunds will be processed within 30 days of receiving the written cancellation request. Refunds will be made to the original payment method or via bank transfer.

4.4 Non-Refundable Items

Certain services including visa fees, travel insurance premiums, and some third-party bookings are non-refundable regardless of cancellation timing.


5. Changes and Amendments

5.1 Changes by Client

Any changes to confirmed bookings must be requested in writing and are subject to availability. Change fees may apply in addition to any charges imposed by airlines, hotels, or other service providers.

5.2 Changes by GESTA Tours & Travel

We reserve the right to make minor changes to itineraries due to operational reasons. Significant changes will be communicated to clients immediately, and alternative arrangements will be offered where possible.


6. Travel Documents

6.1 Passport and Visa Requirements

Clients are responsible for ensuring they have valid passports (with at least 6 months validity from travel date) and appropriate visas for their destination. GESTA Tours & Travel provides visa assistance but is not responsible for visa denials or delays.

6.2 Health Requirements

Clients must comply with all health requirements including vaccinations and medical certificates as required by destination countries. We are not liable for any consequences arising from failure to meet health requirements.


7. Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance covering medical expenses, trip cancellations, lost luggage, and personal accidents. GESTA Tours & Travel is not liable for any costs arising from incidents that would have been covered by travel insurance.


8. Liability and Limitations

8.1 Third-Party Services

GESTA Tours & Travel acts as an agent for airlines, hotels, tour operators, and other service providers. We are not liable for acts, omissions, defaults, or negligence of these third parties.

8.2 Limitation of Liability

Our liability is limited to the total amount paid by the client for the specific service. We are not liable for indirect, consequential, or incidental damages including loss of enjoyment, loss of income, or emotional distress.

8.3 Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our control including but not limited to natural disasters, war, terrorism, civil unrest, strikes, government actions, pandemic, or any other force majeure events.

8.4 Personal Property

We are not responsible for loss, theft, or damage to personal property during travel. Clients should ensure adequate insurance coverage for their belongings.


9. Client Responsibilities

9.1 Accuracy of Information

Clients must provide accurate and complete information including names (as per passport), dates of birth, contact details, and special requirements at the time of booking.

9.2 Conduct

Clients are expected to conduct themselves appropriately during travel. We reserve the right to terminate services without refund if a client’s behavior endangers others, disrupts services, or violates local laws.

9.3 Timely Arrival

Clients are responsible for arriving at departure points on time. We are not responsible for missed flights, transfers, or tours due to late arrival.

9.4 Health and Fitness

Clients must ensure they are physically and mentally fit for the activities included in their itinerary. Any pre-existing medical conditions must be disclosed at the time of booking.


10. Complaints and Disputes

10.1 Complaint Procedure

Any complaints must be reported immediately to our representative or office during travel so we can attempt to resolve the issue. Written complaints must be submitted within 14 days of return via email to reservations@gestatours.com.

10.2 Dispute Resolution

We will make every effort to resolve disputes amicably. If resolution cannot be achieved, disputes will be subject to the jurisdiction of Kenyan courts and governed by Kenyan law.


11. Data Protection and Privacy

We collect and process personal information in accordance with Kenyan data protection laws. Client information is used solely for booking purposes and will not be shared with third parties except as necessary to provide travel services. Clients have the right to access and request correction of their personal data.


12. Special Requests and Accessibility

We will make reasonable efforts to accommodate special requests including dietary requirements, room preferences, and accessibility needs. However, such requests cannot be guaranteed and do not form part of the contract unless specifically confirmed in writing.


13. Group Bookings

For group bookings (10 or more persons), additional terms may apply. Group leaders are responsible for communicating terms to all group members and ensuring compliance. Payment schedules and cancellation policies for groups may differ from individual bookings.


14. Photography and Marketing

By participating in tours organized by GESTA Tours & Travel, clients consent to being photographed or filmed for promotional purposes. If you do not wish to be featured in marketing materials, please inform us in writing.


15. Intellectual Property

All content on our website, marketing materials, and itineraries including text, images, logos, and designs are the intellectual property of GESTA Tours & Travel Ltd. and may not be reproduced without written permission.


16. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


17. Amendments to Terms

GESTA Tours & Travel Ltd. reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website and will apply to bookings made after the effective date of the change.
